The parties herein agree as follows:

The person completing this form, online or in person, and whose details are on this form will be referred to as “the client” in this agreement.

Roadie Tours Pty (ltd) also trading as Roadie Pad & Pet, the staff and dog walker will be referred to as “Roadie” in this agreement.

  • Roadie is authorized to perform care and services as outlined in this agreement.
  • The client is hereby advised to take the necessary insurance, adds Roadie as a dog walker to the insurance for the dog(s) and to inform Roadie of the insurance and liabilities clause of such insurance.
  • The client hereby agrees that they will provide an approved dog walking harness and leash that will ensure that my dog will not be able to break free during a dog walk. Should the dog break free due to improper harness provided by the client, Roadie will be held harmless for consequences related to any accident, incident, or emergency from harness failure.
  • Roadie agrees to keep all dogs harnessed and on their leash at all times during a dog walk. Roadie will only release the leash from the dog with the client’s permission in an approved safe enclosed dog park.
  • The client declares that they have disclosed all prior injuries, illnesses, operations, medical conditions, or any fiscal defect the dog may have or have to Roadie within this agreement. The client also agrees to disclose any new medical condition to the dog walker before a dog walk. Roadie does not take any responsibility for non-disclosure of medical conditions should anything happen to your dog during our care or can Roadie be held liable for any medical condition.
  • Roadie agrees to adhere and comply with all special requests, medical conditions, and client instructions that the client has put in writing to the best of our ability. Roadie will communicate should any request, or instruction cannot be fulfilled and for what reason Roadie will not comply or perform such instruction.
  • The client authorizes Roadie to seek emergency veterinary care with release from all liabilities related to transportation, treatment, and expense should any emergency occur during the dog walk. Should the specified veterinarian be unavailable, Roadie is authorized to engage the services of the veterinarian of their choice. If the client cannot be contacted in a timely manner, Roadie is authorized to approve medical and/or emergency treatment (excluding euthanasia) as recommended by a veterinarian. Client agrees to reimburse Roadie for expenses incurred, plus any additional fees for attending to such emergency, as well as expenses incurred for any other home/dog supplies needed.
  • In the event of inclement weather or natural disaster, Roadie is entrusted to use their best judgment in caring for dog(s). Roadie will be held harmless for consequences related to such decisions.
  • The client (or my homeowner’s insurance) will be responsible for any injury (i.e. pet bite, scratches requiring medical attention) to Dog Walker due to the client’s dog(s).
  • Roadie, its employees, and independent contractors agree to provide the services stated in this agreement in a reliable, caring, and trustworthy manner. In consideration of these services and as an express condition thereof, the Client expressly waives and relinquishes any and all claims against Roadie except those arising from negligence or wilful misconduct (found guilty of in a court of law) on the part of the Dog Walker.
  • The client agrees that Roadie’s official operating times are as follows. Monday to Friday dog walking will be between 9 am and 6 pm, and Saturdays will be 9 am to 1 pm. Any service rendered after these hours will be charged at an extra cost and be seen as overtime. The client will have one of 6 booking slots for dog walking Monday to Friday that falls within these hours.
  • The client agrees that Roadie is not open on any recognized South African public holiday. These days will be credited to your account should you have paid for the 6-day-a-week service. Should you wish Roadie to provide you with the dog walk service on that day, there will charge an extra fee.
  • The client agrees that the “total” walking time as specified within this agreement (above indicted) is the time frame that the walk will occur. This is timed from the time Roadie arrives at your door, as per the agreed walking time, to the time Roadie drops off your dog. Should you or your dog not be available that the agreed walking time, Roadie will not be held responsible for any time lost, and due to a strict timeline we will not be able to extend the time.
  • All payments will be made in advance and paid as per the price agreed by both parties. Should payment not be made, Roadie will not perform the service as agreed to in this agreement. Roadie is not a financial credit provider nor do we have any company that assists with credit on our behalf and therefore cannot extend any credit, or performs services without payment in advance.
  • All unanticipated times and expenses spent during the responsible completion of dog walking duties will be paid upon receipt of an additional invoice.
  • Roadie will adhere to the agreed dates, days, and times of the booking for a dog walk. Should Roadie not be able to walk the dog for any reason, except client cancelation, Roadie will pass credit for that booking that will be deducted from your next month’s invoice.
  • Cancelation by the client and or Roadie for a booking or day must be done 24 hours in advance. Should the cancelation be for a valid reason, Roadie will pass credit for the day or days in question. This credit will be deducted from your next invoice.
  • The client has the right to cancel the agreement with the service on a 24-hour (from the time received by Roadie) notice in writing. Should the client cancel the services of Roadie for a valid reason and has paid in advance, the remainder of the money will be paid back to the client at the rate charged per day for the days that the service will not be rendered. This payment will be transferred to the client’s bank account within a reasonable time frame.
  • I further authorize this agreement to be valid approval for future services permitting this dog walking service to accept my telephone, online or WhatsApp requests or reservations for service and enter my promises without additional signed contracts or written authorizations.
  • Roadie has the right to refuse any service, request, or instruction to or from the client should Roadie feel that it is not in the interest of Roadie or the dog or any party involved.
  • These Terms constitute the entire agreement between the client and Roadie regarding the service rendered. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. The word “including” means “including without limitation”. If any provision of these Terms is held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.  These Terms, and the client’s rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by the client without Roadie’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. Roadie may freely assign these Terms.  The terms and conditions set forth in these Terms shall be binding upon assignees.
