{"id":259,"date":"2023-06-25T07:25:50","date_gmt":"2023-06-25T07:25:50","guid":{"rendered":"https:\/\/roadie.co.za\/padandpet\/?page_id=259"},"modified":"2023-07-03T07:47:36","modified_gmt":"2023-07-03T07:47:36","slug":"pad-pet-sitting-terms-and-conditions","status":"publish","type":"page","link":"https:\/\/roadie.co.za\/padandpet\/pad-pet-sitting-terms-and-conditions\/","title":{"rendered":"Pad &#038; Pet Sitting Terms"},"content":{"rendered":"<p>The parties herein agree as follows:<\/p>\n<p>The person completing this form, online or in person, and whose details are on this form will be referred to as \u201cthe client\u201d in this agreement.<\/p>\n<p>Roadie Tours Pty (ltd) also trading as Roadie Pad &amp; Pet, the staff and house-sitter, pet-sitter or dog-walker will be referred to as \u201cRoadie\u201d in this agreement.<\/p>\n<ul>\n<li>Roadie is authorized to perform care and services as outlined in this agreement.<\/li>\n<li>The client must have the necessary insurance(s). The client must add Roadie as a house sitter to the insurance for the property, content, and pets and inform Roadie of the insurance and liabilities clause of such insurance.<\/li>\n<li>The client hereby agrees that they will provide Roadie Pad &amp; Pet provide with at least one way to enter the client&#8217;s home. You can give us a copy of your house key, garage code, lockbox code, or door code.<\/li>\n<li>Roadie agrees to keep the client&#8217;s keys or access code in a safe place and will not share the key or code(s) with any person except the staff member that needs access to the property.<\/li>\n<li>Roadie will supply the client with a direct contact number for the house sitter in case of an emergency. All instructions, request or any communications must be done in writing by both parties via WhatsApp or email. Should a phone call be made, it must be followed up with a summary of the conversation in writing from the person who initiated the call. Roadie can not be held responsible for any action or instruction not performed that was given during a phone call and not in writing.<\/li>\n<li>Roadie will make every effort to secure the property as per the instructions of the client. Roadie can not be held responsible in the event of a break-in, robbery, or any unlawful act that occurred during the time period of the house sitting agreement.<\/li>\n<li>The client agrees that they will declare all breakage, leaks, or faults in or on the property and condition of the content to Roadie and will be added to the agreement as an addendum.<\/li>\n<li>The Client will lock, or mark any rooms, cupboards, or draws with a post-it written on &#8220;No Entry&#8221; or &#8220;PVT&#8221;, any appliance not to be used written on &#8220;Do Not Use&#8221; and or any item not to be touched written on &#8220;No Touching&#8221;. Roadie agrees to only enter any marked room in case of an emergency should it be the affected room, e.g. window broken on inspection of outside or see fire or smoke but not limited to these examples.<\/li>\n<li>The client will lock away any jewelry, sensitive items or documents, high-value items, and or heirlooms items in a safe secure place.<\/li>\n<li>The client agrees to sign the checklist that Roadie will perform of the property and content and check the time-stamped photographs that will be taken as evidence of the condition of the property and content before the house and pet sitting commences. This will also be added as an addendum to the agreement. This will be repeated with the client at the end of the house and pet sitting period.<\/li>\n<li>The client declares that they have disclosed all prior injuries, illnesses, operations, medical conditions, or any fiscal defect of all the pets they may have to Roadie within this agreement. Roadie does not take any responsibility for non-disclosure of medical conditions should anything happen to your dog during our care or can Roadie be held liable for any medical condition. This will be added as an addendum to the agreement.<\/li>\n<li>Roadie agrees to adhere and comply with all special requests, medical conditions, and client instructions that the client has put in writing to the best of our ability. Roadie will communicate should any request, or instruction cannot be fulfilled and for what reason Roadie will not comply or perform such instruction.<\/li>\n<li>The client authorizes Roadie to seek emergency veterinary care with release from all liabilities related to transportation, treatment, and expense should any emergency occur with a pet(s). Should the specified veterinarian be unavailable, Roadie is authorized to engage the services of the veterinarian of their choice. If the client cannot be contacted in a timely manner, Roadie is authorized to approve medical and\/or emergency treatment (excluding euthanasia) as recommended by a veterinarian. Client agrees to pay all expenses incurred, plus any additional fees for attending to such emergency, as well as expenses incurred for any other home\/dog supplies needed.<\/li>\n<li>In the event of inclement weather or natural disaster, Roadie is entrusted to use their best judgment in caring for the property and pets. Roadie will be held harmless for consequences related to such decisions.<\/li>\n<li>The client (or my homeowner\u2019s insurance) will be responsible for any injury (i.e. pet bite, scratches requiring medical attention) to the sitter due to the client\u2019s pet(s) or any accident that might happen during house sitting with the roam of the duties as set out by the client.<\/li>\n<li>Roadie, its employees, and independent contractors agree to provide the services stated in this agreement in a reliable, caring, and trustworthy manner. In consideration of these services and as an express condition thereof, the Client expressly waives and relinquishes any and all claims against Roadie except those arising from negligence or wilful misconduct (found guilty of in a court of law) on the part of the sitter.<\/li>\n<li>The client agrees that Roadie\u2019s official operating times are as follows. Monday to Friday between 9 am and 6 pm for the office, and Saturdays will be 9 am to 1 pm.<\/li>\n<li>The client agrees that it is impossible for any person to occupy a property 24\/7 for long periods and that the sitter will be allowed to leave the property for certain periods of time not exceeding 4 hours at a time. Should the sitter need a longer time Roadie will provide a stand-in for that period.<\/li>\n<li>The client does agree that the sitter will be allowed to have an authorized guest(s) (not exceeding 3 people at a time) visiting them at the property during that time. The guest will not be allowed to stay over, not even for a night.<\/li>\n<li>The client agrees that the \u201ctotal\u201d time period as specified within this agreement is the time frame that the house and pet sitting service will occur. This is timed from the time Roadie arrives at your door to the time the client arrives back. Should there not be a written request for time to be extended, Roadie will do another checklist with photographic evidence and secure the home as per instructions.<\/li>\n<li>Roadie will only allow payment extension for agreements longer than 7 days. In these cases, a 50% service deposit (part payment) will be payable immediately, and the remainder 50% will be payable immediately on the last day of the house and pet sitting agreement.<\/li>\n<li>All payments will be made in advance and paid as per the price agreed by both parties. Should the deposit or payment not be made, Roadie will not perform the service as agreed to in this agreement. Roadie is not a financial credit provider nor do we have any company that assists with credit on our behalf and therefore cannot extend any credit, or performs services without payment in advance.<\/li>\n<li>The client agrees to ensure that services like lights and water are paid for and all service providers are paid for to ensure a seamless working property at all times.<\/li>\n<li>Roadie agrees to keep all lights and water use to a minimum and as per the instructions of the client.<\/li>\n<li>All unanticipated expenses spent during the responsible completion of the house and pet sitting duties will be paid upon receipt of an additional invoice.<\/li>\n<li>Roadie will adhere to the agreed dates, days, and times of the booking. Should Roadie not be able to fulfill the period for any reason, except client cancelation, Roadie will notify the client not later than 72 hours before the commencement date and will pass credit for that booking and any monies already paid will be transferred to the client\u2019s bank account within a reasonable time frame.<\/li>\n<li>Cancelation by the client and or Roadie for a booking must be done 72 hours in advance. Should the cancelation be for a valid reason, Roadie will pass credit for any monies received. The monies will be transferred to the client\u2019s bank account within a reasonable time frame.<\/li>\n<li>The client has the right to cancel the agreement with the service (from the commencement time by Roadie) on a 24-hour notice period in writing for a valid reason after any dispute could not be resolved that was brought to the attention of Roadie management in writing. Should there be monies that were paid in advance and or a deposit, the remainder of the money will be paid back to the client at the rate charged per day for the days that the service will not be rendered. These monies will be transferred to the client\u2019s bank account within a reasonable time frame. Should there be monies owed to Roadie, an adjusted invoice will be supplied to the client and will be payable within a reasonable time frame.<\/li>\n<li>Any outstanding monies for a period longer than 30 days will be handed to an attorney for collection and all collections fees will be payable by the client. Roadie does not provide any credit services and therefore is not nor am a financial service provider.<\/li>\n<li>Roadie has the right to refuse any service, request, or instruction to or from the client should Roadie feel that it is not in the scope of service that Roadie provides.<\/li>\n<li>These Terms constitute the entire agreement between the client and Roadie regarding the service rendered. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. The word \u201cincluding\u201d means \u201cincluding without limitation\u201d. If any provision of these Terms is held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.\u00a0 These Terms, and the client\u2019s rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by the client without Roadie\u2019s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void.\u00a0Roadie may freely assign these Terms.\u00a0 The terms and conditions set forth in these Terms shall be binding upon assignees.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The parties herein agree as follows: The person completing this form, online or in person, and whose details are on this form will be referred to as \u201cthe client\u201d in this agreement.
